It Isn't 2017 Folks: Birthright Citizenship Being Weaponized by Our Enemies
President Trump ending birthright citizenship is really about ending the ability of hostile foreign countries from weaponizing our broken immigration system.
It’s going to be interesting to see what the courts decide on President Trump’s birthright citizenship executive orders in light of foreign countries weaponizing our broken immigration laws.
Hostile Countries Obtaining U.S. Citizenship for Future Operatives
The Russians and Chinese are part of a wave of birth tourists in Florida and California respectively. Annually, hundreds of pregnant Russian women pay anywhere from $20,000 to $50,000 to brokers in order to arrange their travel to Florida, so they can give birth to future Russians with U.S. citizenship.
On September 13, 2024, a jury Southern California convicted Michael Liu and Phoebe Dong of running a company known as “You Win USA” that helped pregnant Chinese women travel to the U.S. without revealing their plans to give birth to babies who would automatically have American citizenship.
Current Limits to Birthright Citizenship
Children born to foreign diplomats on U.S. soil do not receive citizenship because their parents are not “subject to the jurisdiction of the United States.”
Limitations on Trump’s Birthright Citizenship Executive Order
The E.O. is conservative in its application and limited to only children born 30 days from the date of the order and both parents must be non-citizens. If a child of a foreign diplomat isn’t under our jurisdiction, then it can be safely argued neither is child born from birth tourism and foreign spies. Who else has $20,000-$50,000 to drop on giving their unborn child American citizenship?
Sec. 2. Policy. (a) It is the policy of the United States that no department or agency of the United States government shall issue documents recognizing United States citizenship, or accept documents issued by State, local, or other governments or authorities purporting to recognize United States citizenship, to persons: (1) when that person’s mother was unlawfully present in the United States and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or (2) when that person’s mother’s presence in the United States was lawful but temporary, and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth.
(b) Subsection (a) of this section shall apply only to persons who are born within the United States after 30 days from the date of this order.
(c) Nothing in this order shall be construed to affect the entitlement of other individuals, including children of lawful permanent residents, to obtain documentation of their United States citizenship.
Carrot Meet Stick
President Trump’s previous rhetoric about Latino migrants is going to be used against him in trying to end birthright citizenship. The best way to head this off is by passing DACA that already has stringent requirements.
Also, getting African Americans on board because the 14th Amendment was about giving former slaves citizenship specifically because they were ALWAYS under the jurisdiction of the United States. It was never about giving the children of Chinese and Russian foreign spies citizenship.
A History Lesson from Tejas (Mexican Texas)
In 1821, Mexico allowed Anglos to settle in Mexican Texas and passed the General Colonization Law in 1824, which enabled all heads of household, regardless of race, religion or immigrant status, to acquire land in Mexico. (Mexico today limits coastal property ownership to Mexican citizens only.)
Mexican officials became concerned about attitudes among the Anglos from the South for their insistence on bringing slaves into the territory. The Mexican legislature passed the Law of April 6, 1830, which prohibited further immigration by American citizens. The government established new presidios in the region to monitor immigration practices.
The Anglo immigrants got angry and held a convention in 1832 to demand U.S. citizens be allowed to immigrate to Texas. At a convention the following year, colonists proposed that Texas independence.
On June 26, 1832, the Battle of Velasco was the first true military conflict of the Texas Revolution. On March 2, 1836, Texians declared their independence from Mexico.

If anything, the 2025 inauguration of President Donald Trump with all the former presidents—Democrat and Republican alike— has proven this isn’t 2017. If that’s not enough of a signal for the new Trump administration, Marco Rubio was unanimously confirmed as Secretary of State with a vote of 99-0.
Democrat and Republican leaders don’t have to agree on legislation or public policy, but we have to be united against our enemies. My family is also Hispanic and African American, so even I can see a need to prevent Vladimir Putin and the CCP’s future operatives’ access to U.S. citizenship.
